The following is a report on the lawsuit filed by Brian King Joseph and his Instagram video. ScreenRant and its staff are not affirming or denying the validity of the claims made.
Professional violinist Brian King Joseph seemingly hinted that he was sexually harassed by Will Smith mere days before he filed a lawsuit against the star.
Joseph, who was a finalist on the popular show America’s Got Talent, posted a video on Instagram in which he spoke about a major deal he had been offered earlier in 2025. While he expressed pride in joining a massive tour, he implied that his experience was tarnished by the toxic environment. The musician claimed that if anyone complained about any misconduct at all, they would be punished for it. However, he also urged people to speak up if they ever face harassment, just like he did, even if it means losing out on an opportunity for advancement.
Earlier this year, I was hired to be a performer on a major, major tour with somebody who was huge in the industry. So I was excited, you know, proud of myself for getting the opportunity. Unfortunately, some things happened. I can’t get too into the details of exactly what that was because it’s already a legal issue right now, but the reason why I’m speaking out about this is because getting fired or getting blamed or shamed or threatened or anything like that simply for reporting sexual misconduct or safety threats at work is not okay.
The lawsuit against Smith was officially filed in Los Angeles on December 30, 2025. In court documents, the plaintiff accuses the actor of predatory behavior, claiming that he was groomed and prepared for sexual exploitation during his Based on a True Story: 2025 Tour, which began in March 2025. Joseph was asked to join in November 2024.
According to the lawsuit, the AGT contestant alleged he discovered items including personal hygiene products that didn’t belong to him and a bottle of HIV medication with the name of an undisclosed person, along with hospital discharge papers in his hotel room. He claimed that he found a threatening message that led him to fear that someone planned to return to the room later to assault him.
Joseph reported the incident to hotel security and Smith’s management. However, he claims that the people in charge were dismissive, and he was accused of lying. He was fired shortly after expressing his concerns.
Representatives for Smith have not publicly commented on the allegations at the time of this article’s publication.
