Blake Vigorous is reportedly considering the possibility of withdrawing the emotional distress portion of her lawsuit against Justin Baldoni. However, this decision is complicated by certain conditions that are delaying the process, as indicated by his legal representatives.

The legal team representing the actor has communicated with the presiding judge regarding the case, asserting that Blake is weighing the option of dropping her emotional distress claim. The reason for this potential withdrawal is her reluctance to relinquish her medical records, which Baldoni’s team has requested from Vigorous as part of the ongoing litigation process.

Attorney Bryan Freedman, representing Baldoni, has stated that they have been in discussions with Blake’s legal team about the requested medical documentation. However, these discussions have reached an impasse, complicating the situation further.

Freedman indicates that Blake wishes to withdraw the emotional distress claim without prejudice, which would allow her the opportunity to refile it in the future if she chooses to do so. This approach provides her with a strategic advantage in the ongoing legal proceedings.

On the contrary, Baldoni’s legal team is seeking that the emotional distress claim be withdrawn with prejudice. This stipulation would prevent Vigorous from changing her mind and potentially refiling the claim in the future, thereby solidifying their position in the case.

Baldoni is urging the judge to intervene and either compel Vigorous to submit all requested medical documentation or to agree to dismiss the claims entirely with prejudice. This request highlights the tensions and challenges in the legal proceedings.

Blake’s attorneys, Esra Hudson and Mike Gottlieb, shared with TMZ that this situation is a standard part of the litigation process, which they believe has been manipulated into a media spectacle. They emphasized that they are diligently preparing their case for trial while accusing the opposing side of seeking sensationalized tabloid coverage.

Furthermore, they added, “The Baldoni-Wayfarer strategy of filing retaliatory claims has exposed them to expansive new damages claims under California law, making some of Ms. Vigorous’s original claims no longer necessary. Ms. Vigorous continues to assert emotional distress among other allegations in her lawsuit, including sexual harassment, retaliation, and significant additional compensatory damages for all of her claims.”

As you may be aware, both Blake and Justin are embroiled in a legal dispute against each other stemming from their collaboration on the film “It Ends with Us.” Vigorous alleges that Baldoni sexually harassed her during the production, adding further complexity to the ongoing legal battle.

Baldoni responded by asserting that Vigorous attempted to undermine him with the intent to effectively take control of the movie’s production for herself, while simultaneously fabricating allegations of sexual harassment during the process.
